I am not a lawyer, as if that has anything to do w/ anything, but two things stand out here: The Clipper franchise itself, which one might assume to be the entity that would be most affected by Sterling's fool comments, sold for U.S.$2,000,000,000.00 (That's billions.) which I'm pretty damn sure is the record for any sport franchise, or very close. And considering the Dodgers (slightly more prestige, success, valuable near-downtown real estate stolen from the city, large & dedicated fan-base) sold for the same price two yrs. ago, I fail to see how the N.B.A. has been devastatingly & incalculably harmed.The NBA filed a counterclaim against Donald Sterling and the Sterling Family Trust in federal court Monday, saying the Clippers owner caused “devastating and incalculable harm” to the league.
Filed in U.S. District Court in Los Angeles in response to Sterling’s June antitrust lawsuit against the NBA and Commissioner Adam Silver, the counterclaim seeks to recover damages related to the owner’s recorded comments denigrating blacks.
If anyone, they should be suing former commissioner David Stern for allowing Sterling to continue owning the team after his record housing discrimination settlement. Not to mention Sterling's deserved reputation as an absolute fucking joke as a team-owner. Stern should have rousted his ass long ago. Having a joke team didn't harm the N.B.A.? And what is this?
Sterling must indemnify the NBA against losses and litigation according to the league’s constitution and a July 2005 document he signed, the counterclaim said. Shelly Sterling also signed an agreement in May to indemnify the NBA for any litigation costs related to her husband’s lifetime ban from the league, his $2.5-million fine and the franchise’s sale.No idea what Sterling signed in 2005; was it related to the housing discrimination suit against him that he settled in 2005 as well?
